When my better half had an appointment with ATOS we had to phone up three times to explain to them that the building they hold their appointment in wasn't suitable because it had over 50 steps to the floor the appointments are held on and the lift is shut down in the event of a fire. In the end we managed to get a home visit from a Dr, in the midst of threatening letters from DwP and Atos for changing appointments all the time. The fact that the two weren't telling each other what was happening had to be spelled out to them before they apologised. And they then cancelled the home visit 4 times.
in the end Karen ended up on the ESA with the going to see some one at the job centre to help her get back to work. Just how they are going to find a job for some one with ME/CFS, fibromyalgia (sp?) sever back problems, in need of a knee replacement, arthritis, panic attacks and who hasn't been out of the house by her self in over 10 years I don't know. Plus they keep on giving her appointments at the Job centre on days when I have to go to the neurologist or one of my other specialists.
Best bit is the Atos building has banned disabled people in wheelchairs or on crutches from even being in the lobby because it's not a suitable building for them.
ATOS...rant!!

I may be wrong here, but, don't they have to restore your benefits once you begin the appeal process. The initial assesment is not carried out by medically qualified personnel so the very act of appealing means you revert to innocent until proven guilty, so to speak.bezzabsa wrote:been claiming ESA since Jan this year (mental health issues) and also
my tablets make me unfit to drive, already lost my HGV licence, i have arthritis and other issues that make it impossible to sit or stand for more than 15 mins at a time, and cant walk for more than 30 feet without stopping due to the pain....The Medical review was a complete farce...loads of irrelevant questions NONE of which were about my mental state..Gunna apply for an appeal and see what happens!!
Gunna be fun when I see my 'advisor' tomorrow to see what job i can do - gunna take my tablets and ALL the side effects, possibly get them to read through

Errrm,
Of course i'm in Scotland and it may be different but they closed up That loophole years ago...that would be the sensible option so...NO.Dr Death wrote:I may be wrong here, but, don't they have to restore your benefits once you begin the appeal process. If you appeal DLA you get nada until after hearing. So if you win you get a windfall, to pay all the debt you have accrued, and if you lose...you can't even backdate the ESA?! You can sit on ESA on JSA and appeal DLA tho?! But you have to sign on and look for work etc?! :(

Well just been to sign for JSA - as I was told to...got there and for once got a human being that actually understood the situation ....and have been told that " If I claim JSA i'm basically admitting that YES I agree with the decision and I am able to work " BUT.. have been told to Appeal the ESA and I automatically get put back on it while its being asessed!!!!:hellfire:
WHY they dont explain this in their bumf i'll never know...
Lev - I now a guy with MS - was diagnosed about 20yrs ago, and even he has had hassle with the Atos 'little hitlers'.... even resorted to getting a solicitor to fight his case with the docs support...they eventually caved in and admitted they were wrong....I'm not trying to be a scammer, I just want them to admit they cant assess mental issues with a physical ssessemnt..
I used to drive HGV's and I started to fear for mine - and other peoples safety, especially when the doses started creeping up and up, I was doing the syupid man thing and saying all was well...when eventually I had to admit it was far from well...Hardest thing ive ever had to do!!!!!
